A new bill, passed on Wednesday by the California Senate, requires the California Department of Justice to erase, or significantly reduce, past cannabis convictions. The Department has been ordered to identify cases from 1975 - 2016 that may be eligible for re-evaluation. This bill comes two years after the state passed Proposition 64, which led to California legalizing cannabis for recreational use at the beginning of this year.

Democratic Assemblyman Rob Bonta, who represents parts of Oakland, introduced the bill, which was <a style="color: #007d6b;" href="http://blog.greenrush.com/san-francisco-expunge-marijuana-records/">passed</a> in the lower house earlier this year. The Senate passed the bill with a 22-8 vote on Wednesday. It will now move to Governor Jerry Brown's office to receive his signature.

Under Proposition 64, California determined that many marijuana 'crimes' were no longer illegal and retroactively applied the decision to past cases. Until now, it was up to the individual to apply to have their cases evaluated which was a costly, time-consuming process. However, the passage of Wednesday's bill has made the process more accessible, and more cost-effective.

Senator Scott Wiener (D), a staunch supporter of the bill, noted that its passage "creates a simpler pathway for Californians to turn the page."

It is estimated that close to 220,000 cases need to be evaluated, which will result in erasure or reduction for each.

California's Department of Justice has until July 1, 2019, to identify all eligible cases after which prosecutors will have 1 year to challenge the cases.

California Lawmakers Pass Bill To Erase Past Cannabis Convictions

One of the largest banks in the United States, Wells Fargo, has shut down the campaign account of Florida political candidate Nikki Fried (D). The reason? She said she'd be willing to accept campaign donations from the cannabis industry.

Fried is running to be Florida's agriculture commissioner and has a long history of supporting the marijuana industry. She has worked as a lobbyist on behalf of the industry and has been outspoken in her support for cannabis. Prior to running for the position, she ran the lobbying firm <a style="color: #007d6b;" href="http://www.ignitingflorida.com/">Igniting Florida</a>, which describes Fried on its website as "one of the most visible faces and key activists in Florida's burgeoning medical cannabis industry."

According to documents <a style="color: #007d6b;" href="https://nikkifried.com/press-release-wells-fargo-terminates-democratic-ag-commissioner-candidate-for-pro-medical-marijuana-political-platform/">released</a> by Fried's campaign, their campaign account was opened with Wells Fargo on June 13. On August 3, Wells Fargo notified the campaign its account was being terminated due to Fried's "relationship to the medical marijuana industry." A formal notice followed, which stated that "as part of our responsibility to oversee and manage banking risks", the account was being shut down.

Wells Fargo declined to comment specifically on Fried's campaign account but stated that its policy does not allow for ties to the cannabis industry.
&nbsp;
"It is Wells Fargo's policy not to knowingly bank or provide services to marijuana businesses or for activities related to those businesses, based on federal laws under which the sale and use of marijuana is illegal even if state laws differ," said spokeswoman, Bridget Braxton.

United States banks have thus far made sure to distance themselves from the cannabis industry, despite a growing number of states legalizing weed for either medical or recreational use. The cannabis industry is one of the fastest growing industries in the US but faces numerous financial hurdles due to the unwillingness of banks to handle cannabis-related funds. At the retail level, <a style="color: #007d6b;" href="http://blog.greenrush.com/cannabis-bank-california-moves-forward/">many dispensaries are not able to accept credit cards</a>, resulting in large amounts of cash being kept on site, making dispensaries a target for robberies.

At the federal level, cannabis remains illegal in the United States. The federal government's stance on banks handling legitimate cannabis funds is still unclear, forcing many banks to opt out of the marijuana industry entirely. In 2014, the Treasury Department's Financial Crimes Enforcement Network provided a checklist for banks on things to look out for when providing services to legal cannabis businesses. Despite the lack of guidance from the federal government, it seems Wells Fargo stands alone in its stance on Fried's campaign. Representatives for Bank of America, Citigroup, and JPMorgan Chase have stated that their banks' policies would not prevent them from offering their services to Fried's campaign. BB&amp;T has now taken over Fried's account, demonstrating that some banks seem to be open to working with cannabis advocates, a least in the political arena. Wells Fargo Closed Florida Candidate's Bank Account After She Said She'd Take Donations From The Cannabis Industry

Canada has become the second country in the world to legalize cannabis for recreational use. In a historic move, the Senate passed bill C-45 on Tuesday with a 52-29 vote. Canada is the first G7 nation to legalize cannabis.

Uruguay was the first country to legalize the sale of cannabis for recreational use in 2013.

The last of these hurdles, to gain <a style="color: #007d6b;" href="http://blog.greenrush.com/canadian-senate-approves-cannabis-legalization-bill-dozens-amendments/">Senate approval</a>, has now been overcome and Royal Assent will likely be received this week after which the Canadian government will decide when the new law will take effect. At this point, individual provinces will begin making plans for recreational cannabis implementation within their jurisdictions.

Although cannabis is now officially legal in Canada, <a style="color: #007d6b;" href="http://blog.greenrush.com/recreational-weed-in-canada/">Canadians will have to wait</a> 8 - 12 weeks until recreational cannabis is available for purchase. Canadian provinces and territories will use this time to implement their own laws and processes around recreational cannabis purchase and consumption.

Under new Canadian law, adults 18 and over will be able to possess 30 grams of cannabis in public. Individual provinces retain the right to increase this minimum age if they so see fit. Cultivation allowances will permit adults to grow up to four plants per household and purchasing laws will require Canadians to buy cannabis from either federally or provincially regulated retailers only.

There will also be strict laws on edibles, which are likely to become available for sale later than other cannabis products, due to additional time being needed for the government to impose laws on cannabis foodstuffs. All cannabis products will have to be sold in plain packaging with no branding that could appeal to children.

The Trudeau government has argued that Canada's previous laws prohibiting cannabis use have long been ineffective, as demonstrated by multiple studies proving Canadians to be some of the heaviest cannabis users in the world. Canada will likely serve as an example for various nations tentatively moving towards more liberal attitudes towards cannabis. Cannabis remains federally illegal in the United States but is now recreationally legal in nine states and medically legal in 29 states and the District of Columbia. Advocates in the United States continue to push for federal legalization as their neighbors to the north move into a new phase of cannabis history.

Canada Has Officially Legalized Cannabis For Recreational Use

A move to split California into three separate states has gained enough signatures to qualify it for the November ballot.

California's secretary of state confirmed the news on Tuesday.
&nbsp;
The initiative, which has become known as 'Cal 3' has gained over 600,000 signatures and is sponsored by Tim Draper, a Silicon Valley venture capital investor and billionaire.

According to Draper, the "California government has rotted. We need to empower our population to improve their government."

If the initiative to split California goes ahead, the state would be separated into three different entities; California, Northern California, and Southern California.

California would include the Los Angeles, Ventura, and Santa Barbara counties while Northern California would be made up of 40 counties including San Francisco, Sacramento, and Santa Cruz. Southern California would encompass 12 counties including the Kern and San Diego counties.

California has been a single entity state since its founding in 1850. If 'Cal 3' goes ahead, it will be the first time a state has split since West Virginia was created in 1863.

This isn't the first time a move to split California has been proposed. Draper previously proposed California be split into six areas and activists continue to run a highly publicized campaign known as 'Calexit' which proposes California secede from the United States altogether.
&nbsp;
Those opposed to Draper's initiative have been taking comfort in the fact that even if the ballot measure was approved by voters, it would still face several challenges. Lawmakers in both houses of California's legislature would have to approve the measure as well as Congress. It is unlikely this would happen without major opposition.

According to Steve Maviglio, a Democratic political strategist, "this measure would cost taxpayers billions of dollars to pay for the massive transactional costs of breaking up the state, whether it be universities, parks or retirement systems. California government can do a better job of addressing the real issues facing the state, but this measure is a massive distraction that will cause political chaos and greater inequality."

It remains unclear how such a move would affect current laws in the state. Students are curious as to how the measure would affect tuition and if they would be required to pay out of state fees for schools only miles away. In a historic move, the Senate approved the bill, however, cannabis is not legal in Canada yet. As some expected, the Senate's approval came with dozens of amendments which must now be either approved, modified or rejected as the bill is passed back to the House of Commons.

Whilst some of the amendments made by the Canadian Senate are minor, and not likely to cause contention, others are more problematic. One, in particular, would allow provinces to ban home cultivation of cannabis if they so choose. Under the current wording of the bill, there remains room for provinces to be subject to legal challenges if they choose, like Quebec and Manitoba have, to prohibit home cultivation allowances. The Senate's proposed amendment would eliminate this possibility.

Brands may also be subject to even more restrictions under the Senate's amendments to the bill. It is possible that <a style="color: #007d6b;" href="http://blog.greenrush.com/canadian-cannabis-law-bans-celebrity-endorsement/">cannabis advertising</a> via merchandise such as t-shirts and baseball caps, for example, may be prohibited as well.

Canada is set to make history this week as the first G7 country to legalize cannabis for recreational use.

Bill C-45 would legalize the purchase and use of recreational weed for adults over the age of 18. The bill has successfully passed through the House of Commons and will be voted on by the Canadian Senate today. The Senate has been reviewing the bill for six months and is expected to pass the bill without issue.

Providing the Senate passes the bill, it would then head back to the House of Commons, where lawmakers will review any amendments made by the Senate. Canadian law then requires royal assent to be given, whereby Canada's sovereign must approve the bill after it has passed through both the House of Commons and the Senate. These days, royal assent is but a formality and will likely not hinder the bill from becoming part of Canadian law.

However, if the House of Commons doesn't agree with the amendments set forth by the Senate, it could delay the bill from passing. If that happens, the bill would be passed between the two until both agreed upon the final wording of the bill.

Depending on what each province deems appropriate, some may enact different laws with regards to smoking in public or personal grow allowances.

Nevertheless, on the federal level, at least, adults will be allowed to carry a maximum of 30g (just over an ounce) of cannabis. Driving under the influence of weed will be strictly prohibited and enforced, and cannabis branding will be severely limited.

The way in which legal recreational cannabis plays out in Canada may have some bearing on US law in the future. Canada could provide a positive example for the United States, where weed remains illegal on the federal level. Though an increasing number of states are legalizing medical cannabis, only nine states so far have legalized adult-use weed.

Back in April, the State Board of Canvassers decided that cannabis advocates had gathered enough signatures on their initiative to legalize weed in the state for it to make it to the ballot. There ensued a 40-day deadline for lawmakers to take issue with the initiative. No such issue was taken up within the 40-day period and now, the initiative will be on the November ballot.

If the vote passes, the possession and sale of up to 2.5 ounces of cannabis would be made legal in the state of Michigan for adults 21 and over. There would also be a 10 percent tax on all weed sales on top of the regular 6 percent sales tax. Revenue from the taxes collected would be used to fund public education, roads, and be split between local governments.

Medical cannabis has been legal in Michigan since 2008. If Michigan voters vote yes, the state will become the 10th in the country to legalize cannabis for recreational use.

Rep. Earl Blumenauer Says Cannabis Will Be Descheduled Within Next Few Years

A federal appeals court has sided with the Drug Enforcement Administration, ruling that <a style="color: #007d6b;" href="http://blog.greenrush.com/what-is-cbd-2/">CBD</a> is a Schedule 1 substance under federal law.

The decision, made on Monday by a 9th Circuit three-judge panel in San Francisco, delivers a huge blow to the hemp industry, which, in previous years, had made millions of dollars in revenue. According to <a style="color: #007d6b;" href="https://hempindustrydaily.com/hemp-industry-loses-dea-appeal-as-federal-appeals-court-says-cbd-a-controlled-substance/">Hemp Industry Daily</a>, hemp companies will now only be allowed to sell CBD products in states where cannabidiol is legal under state law.

Back in 2016, the Drug Enforcement Agency issued a 'clarifying rule', stating CBD is an illegal drug because it is produced from the marijuana flower. However, various hemp companies pushed back against the ruling, stating that CBD can also be extracted from the hemp flower and that the DEA was trying to add a new substance to the Controlled Substances Act, an action out of line with its duties.

However, the DEA claimed it was only 'clarifying' existing law and officials claimed there were "no substantive change to the government's control of any substance."
&nbsp;
On Monday, the 9th Circuit agreed with DEA, effectively allowing its rule on CBD to take effect.
&nbsp;
Those in the hemp industry wishing to appeal the decision now have 45 days in which to do so. If the 9th Circuit once again sides with the DEA, the hemp industry could appeal the case to the U.S. Supreme Court.

Michael Brubeck, CEO of Centuria Natural Foods, <a style="color: #007d6b;" href="https://hempindustrydaily.com/hemp-industry-loses-dea-appeal-as-federal-appeals-court-says-cbd-a-controlled-substance/">told</a> Hemp Industry Daily, "We will be appealing, and we will be funding that appeal."

The 2016 DEA rule put many of these states in violation of federal law and the 9th Circuit's recent support of that rule has made it clear CBD in all forms is federally illegal.
&nbsp;
It seems, for now at least, CBD remains illegal under federal law, regardless of whether it is derived from the hemp or marijuana plant.
